Walmart, Inc.
FDA issued a warning letter to Walmart, Inc. (President/CEO John Furner) regarding three unapproved new drug products — 'HClear for him,' 'Herstat GST,' and 'Terragen HG Formula' — sold on walmart.com and fulfilled through Walmart Fulfillment Services. These products bore labeling claims indicating intended use for treatment of genital herpes symptoms and genital sores (STIs), making them unapproved new drugs under sections 301(d) and 505(a) of the FD&C Act. FDA warned that consumers relying on these products may forgo appropriate medical care, risking infertility, sepsis, or death, and may unknowingly transmit infections. Walmart was directed to respond within 15 business days with corrective steps, and FDA warned that failure to comply may result in seizure or injunction.
